On June 12, 2009, the Tennessee General Assembly voted to change our state's process for selecting intermediate appellate and Supreme Court judges.  Though the process is still inconsistent with our state Constitution, it provides more transparency and more accountability than the "Tennessee Plan."

As the Wall Street Journal observed,
Tennessee is moving the dial on how it chooses judges, changing parts of the so-called merit selection method that has governed the state for decades. Under a new plan approved by the legislature on Friday, the lawyers who have dominated judicial selection are getting put back in their place.

Indeed, and until proponents of commission-based selection of judges change Tennessee's Constitution to accommodate their preferred system, this issue will not go away; so look for a battle when the Judicial Commissions created in 2009 come up for review in two years.
